When we listen to music, what do we listen to and for? How do we listen? How well do we listen and how do we listen well? This paper suggests that ‘modes of engagement’ are the active, operational means by which listeners experience music and that listening experiences more often than not involve multiple interacting modes rather than a fixed mode throughout. Modes of engagement may be voluntarily employed or involuntarily adopted; they may be technical or descriptive; they may involve (...) explicitly musical details and relationships, or they may seem more peripheral to the music. In the end, though, successive, simultaneous, and interacting modes of engagement are said to define unique and meaningful trajectories through music as heard. (shrink)

Emotions are keys to understanding the response to environmental problems. We discuss three important roles. First, emotions like worry, anxiety, pride and hope can motivate pro-environmental behaviour. Second, emotions are also consequences; the emotional impacts of environmental degradation, such as climate anxiety, can affect mental health, and recognising these impacts is necessary to encourage individual and societal resilience. Finally, emotion also has a communicative function and is part of shared experience. The ability to describe and elicit shared emotions in response (...) to environmental problems allows those problems to become part of social discourse, which is necessary for addressing them. No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

According to moral error theorists, moral claims necessarily represent categorically or robustly normative facts. But since there are no such facts, moral thought and discourse are systematically mistaken. One widely discussed objection to the moral error theory is that it cannot be true because it leads to an epistemic error theory. We argue that this objection is mistaken. Objectors may be right that the epistemic error theory is untenable. We also agree with epistemic realists that our epistemological claims are not (...) systematically in error. However, this is not because there are robustly normative facts, but rather because the truth of our epistemic claims doesn’t turn on whether there are such facts. Epistemic facts, we argue, are not robustly or categorically normative. Moral error theorists should therefore respond to the objection that their view does not commit them to the epistemic error theory. (shrink)

This article investigates the role of the body in Jean-Luc Nancy’s powerful essay Corpus, and critiques it from the standpoint of Agamben’s biopolitics. For Nancy, the body becomes the privileged site of both existence and sense in a way that threatens to obscure the logic of exceptional decision that Agamben takes from Carl Schmitt. As an alternative to Nancy’s understanding of the body, we can see in Deleuze a series of bodies that works in parallel to a series of sense (...) or language, where sense and body do not get collapsed into each other. At the same time, contemporary continental philosophy resists the idealistic separation of thinking and embodiment. Deleuze calls this relation between sense and body a cut, but we could also consider a parallax, following Slavoj Zizek. Finally, African-American historian of religion Charles H. Long’s work complements some of Deleuze’s insights in a more explicitly postcolonial context. (shrink)

This Afterword looks back over both parts of the discussion of “God and the World of Signs”—“Semiotics and the Emergence of Life” in the previous issue of Zygon and “Semiotics and Theology” in this issue. Three central questions in this extended debate are identified: What is the nature of biological organisms and biological evolution? What is the relationship between the natural world and the Triune God of the Christian theological tradition? What should be the goals of Science/Religion Studies? I summarize (...) the answers that Christopher Southgate and Andrew Robinson have given in their program and the challenges raised by their critics. Their strengths and weaknesses are assessed. In the conclusion I ask readers to imagine that this particular research program were to be taken as a model program in science-and-religion research (with some tweaking) and then consider the features of the program that could function as standards for scholars working in other areas of the dialogue. In the West panentheism is known as the view that the world is contained within the divine, though God is also more than the world. I trace the history of this school of philosophy in both Eastern and Western traditions. Although the term is not widely known, the position in fact draws together a broad range of important positions in 20th and 21st century metaphysics, theology, and philosophy of religion. This new edition of Charles Fried's 'Medical Experimentation' includes a general introduction by Franklin Miller and the late Alan Wertheimer, a reprint of the 1974 text, an in-depth analysis by Harvard Law School scholars I. Glenn Cohen and D. James Greiner, and a new essay by Fried reflecting on the original text and how it applies to the contemporary landscape of medicine and medical experimentation.

In “The Choice Theory of Contracts,” we explain contractual freedom and celebrate the plurality of contract types. Here, we reply to critics by refining choice theory and showing how it fits and shapes what we term the “Contract Canon”. I. Freedom. (1) Charles Fried challenges our account of Kantian autonomy, but his views, we show, largely converge with choice theory. (2) Nathan Oman argues for a commerce-enhancing account of autonomy. We counter that he arbitrarily slights noncommercial spheres central to (...) human interaction. (3) Yitzhak Benbaji suggests that choice theory’s commitment to autonomy is overly perfectionist. Happily, in response to Benbaji, we can cite with approval Charles Fried’s point that contract types are “enabling our liberties.” II. Choice. (4) Aditi Bagchi criticizes our inattention to impediments to choice. We show how choice theory’s commitments to both multiplicity and relational justice ameliorate these impediments. (5) Gregory Klass explores parol evidence to highlight the mechanisms of choice. We substantially concur with his position, and show how such mechanisms can ensure voluntariness, an essential element of choice. (6) Oren Bar-Gill and Clayton Gillette question the institutional capacity of existing legal actors to implement choice theory. Working from the example of cohabitation, we offer a somewhat more optimistic view. III. Contracts. (7) Peter Benson contends our focus on the rational slights the reasonable. Although we did not use this Rawlsian vocabulary, choice theory complies with its strictures — more so than transfer theory. (8) Daniel Markovits and Alan Schwartz claim provocatively that contract theory must: capitulate before pluralism (as they endorse); leverage it; or fall victim to a so-called “embracing” approach (their charge against us). We reject the charge that choice theory is foundationally value-pluralist. Instead, we cabin pluralism and put it to work. (9) The Contract Canon starts on the next big step for choice theory by explaining existing doctrine (rebutting Benson on lack of fit) and helping adjudicate contract practice (countering Markovits and Schwartz on the vices of our pluralism). Each Article in this Issue advances the field; each prompts us to refine choice theory — all steps, we hope, toward a more just and justified law of contract. (shrink)

Recently I’ve been reflecting on the possibility that choices I’ve made and commitments I’ve accepted — choices and commitments like being part of the academy and treating philosophy as a productive way to pursue truths about race and racism — may have made me into Philosophy’s mammy. Confronted with a crystal-clear specter of myself as mammy, I stubbornly hold fast to the belief that my intellectual identity can be defended to all of my intellectual ancestors: my ancestors in the canon (...) of Western Philosophy, but also my intellectual foremothers and forefathers: Audre Lorde, Cherrie Moragua, Toni Morrison, Patricia Hill Collins, Cornel West, Charles Mills. Some of those to whom I owe an intellectual debt are more like cousins. Alongside philosophers like Kristie Dotson and Donna-Dale Marcano, among others, I occupy a very unique position. It is to them, perhaps, that I most need to give an account myself. I believe that I can give an earnest defense that is not simply self-serving, not an easy way out, and not a concession. The goal of this essay is to investigate this worry. What is revealed is not just the personal, social, and professional location of one particular philosophy; Perhaps surprisingly, I may be an inevitable event and valuable stage in the ongoing progress of Black Feminist Philosophy. The English translation of the winner of the Victor Barbeau Prizeand finalist of the Governor General's Literary Award.

In this paper I argue for a distinction between subjective and value laden aspects of judgements showing why equating the former with the latter has the potential to confuse matters when the goal is uncovering the influence of political influences on scientific practice. I will focus on three separate but interrelated issues. The first concerns the issue of ‘verification’ in computational modelling. This is a practice that involves a number of formal techniques but as I show, even these allegedly objective (...) methods ultimately rely on subjective estimation and evaluation of different types of parameters. This has implications for my second point which relates to uncertainty quantification—an assessment of the degree of uncertainty present in a particular modelling scenario. I argue that while this practice also involves subjective elements, in no way does that detract from its status as an epistemic exercise. Finally I discuss the relation between accuracy and uncertainty and how each relates to judgements that embody social/ethical/political concerns, in particular those associated with high consequence systems. The COVID-19 pandemic caused university education to transition from face-to-face contacts to virtual learning environments. Young adults were forced to live an entirely new life online, without valuable and enjoyable social interaction. We examined subjective perspectives towards life online during the pandemic. We identified four viewpoints about life mediated by computers. Two viewpoints express “struggling”: Viewpoint 1 (Angry, Depressed and Overwhelmed), and Viewpoint 3 (Restricted to and Overwhelmed by Virtuality). A third feeling-state conveys experiences of “surviving”: Viewpoint 4 (Isolated and (...) Powerless in Convenience). Surprisingly, Viewpoint 2 is about “thriving” (Comfortable and Convenient Routine with Computers). The research shows that virtualization, confinement, and anxiety are taking a toll on the mental health of some members of the younger generation, while at the same time other members feel they are thriving in a situation of limited resources, virtuality, and reduced face-to-face human interaction. This article revisits Jeffrey Tulis’s The Rhetorical Presidency in the age of Trump, discussing the debates to which it originally responded, its core thesis and empirical evidence, as well as its impact on political science in the last three decades. The article’s second half turns to a recent critique of Tulis’s thesis by Ann C. Pluta, which manifests many of the misunderstandings that have persisted since The Rhetorical Presidency’s original publication. Habits of thought revealed in Pluta’s misunderstandings, I argue, are (...) emblematic of the political culture that is amenable to the simplistic yet politically effective appeals characteristic of rhetorical presidents like Donald Trump. Elements of the broader political-science world that are on display in Pluta’s article are symptomatic of political pathologies sustained and aggravated by the culture of the polity that political scientists inhabit and purport to study—the culture of the rhetorical presidency. I argued that the frameworks and mechanisms that produce unification do not enable us to explain why the unified phenomena behave as they do. That is, we need to look beyond the unifying process for an explanation of these phenomena. Anya Plutynski ([2005]) has called into question my claim about the relationship between unification and explanation as well as my characterization of it in the context of the early synthesis of Mendelism with Darwinian natural selection. In this paper I argue (...) that her methodological criticisms rest on a misinterpretation of my views on explanation and defend my historical interpretation of the work of Fisher and Wright. Some very persuasive arguments have been put forward in recent years in support of the disunity of science. Despite this, one is forced to acknowledge that unification, especially the practice of unifying theories, remains a crucial aspect of scientific practice. I explore specific aspects of this tension by examining the nature of theory unification and how it is achieved in the case of the electroweak theory. I claim that because the process of unifying theories is largely dependent on particular kinds (...) of mathematical structures it is possible to have a theory that displays a degree of unity at the level of theoretical structure without an accompanying ontological unity or reduction. As a result, unity and disunity can coexist not only within science but within the same theory. (shrink)

The chromodomain is a highly conserved sequence motif that has been identified in a variety of animal and plant species. In mammals, chromodomain proteins appear to be either structural components of large macromolecular chromatin complexes or proteins involved in remodelling chromatin structure. Recent work has suggested that apart from a role in regulating gene activity, chromodomain proteins may also play roles in genome organisation. The main section of this volume of essays addresses the topic of 'Performativity in Literature and Music', a subject of high contemporary relevance since a substantial part of recent reflections in the humanities are concerned with the performance aspect of cultural activities, particularly in the arts. This decisive reorientation of scholarly interests in the arts, trendily called the 'performative turn', has yielded significant contributions to an increasingly refined understanding of artistic processes from an up-to-date perspective, and specifically what has been (...) called the 'crisis of the work concept' has sharpened our awareness of the need of finding the 'proper' object of such scholarly investigations, which, as in most traditional studies, cannot be exclusively the written documents of our cultural heritage, but additionally, and essentially so, their actualizations in performance situations. This volume for the first time offers a set of careful case studies from a wide range of artistic genres (narrative fiction, poetry, opera, instrumental music, songs, jazz) and historical phases (from Elizabethan verse to 21st-century HD opera performances) which give detailed insight into consequences of addressing issues of performativity in the field of word and music studies. Closely examined examples range, in music, from the romantic reception of Bach and the opera singer Maria Malibran through Mahler and Schoenberg to Brigitte Fassbaender, Philip Glass and Charles Mingus, and, in literature, from Sidney through Yeats and Celan to Katherine Mansfield, Alejo Carpentier and Toni Morrison.
